Hearing to continue today on the House dissolution case

KATHMANDU: Hearing on the case of dissolution of House of Representatives is to continue today at the Supreme Court.

Constitutional bench led by Chief Justice Cholendra Shumsher JB Rana is scheduled to hear the case. The bench further comprises Justices Bishwambhar Prasad Shrestha, Tej Bahadur KC, and Anil Kumar Sinha. Supreme Court Justice Hari Krishna Karki had recused himself from the case after two of the petitioners — Senior Advocates Dinesh Tripathi and Shambhu Thapa — pointed out conflict of interest for Karki in the case.

The Chief Justice Rana is expected to designate another justice in today’s bench.

However, the matter is still under discussion whether the hearing will be carried out through the constitutional bench or a grand full bench.

Thirteen petitioners had filed a writ against the dismantling of the Lower House. They demanded the formation of a grand full bench for which a petition has already been submitted. Their lawyers would plead before the constitutional bench in favour of the formation of a grand full bench.

According to the petitioners, a larger bench needed to be formed to hear the House dissolution case, as majority of the justices needed to take ownership of the apex court’s verdict.

The Supreme Court has listed the House dissolution case for continuous hearing. Five amici curiae nominated by the Nepal Bar Association and Supreme Court Bar Association will also plead in the case.
